USCIS Fee Increase Halted

Today was the dreaded fee increase day for immigrants and immigration practitioners alike. On August 3, 2020, United Citizenship & Immigration Services (USCIS) published a Final Rule that was set to change filing fees. This proposed rule was set to increase the fees of many application with some costs increasing more than 50% of the current fees.
The fee increase was set to be effective on all application submitted on or after October 2, 2020. However, on September 29, 2020, a California judge blocked that final rule from going to effect. The district court stayed the implementation of the rule and the effect date, meaning the increased fees and the anticipated policy changes cannot be applied.
With the current injunction in place, many are still left wondering how long the injunction will remain in effect. Unfortunately, it is impossible to say and we are all in limbo about what to expect. The government has 60 days to file an appeal, but to date, no appeal has been filed by the government.
With that said, we highly recommend to those who were delayed in meeting the October 2 deadline to use this time to get all their information ready to file their applications ASAP!
